What is PC1000 Diversion? Its Implications for Immigrants Arrested at Coachella or Stagecoach?

Penal Code 1000 gives those convicted of simple possession of drugs an opportunity to undergo treatment and education instead of serving jail. The accused must enter a “guilty” plea, following which the drug diversion program of 18 months must be completed. Then, the charges are dropped, and usually, there is no criminal record left.

Eligibility for PC1000 pretrial drug diversion entails that the charges must be of drug possession for personal use. A charge of possessing drugs for sale or transportation renders a defendant ineligible for PC1000 diversion.

For immigrants and non-US citizens, a PC1000 diversion could render them ineligible to stay in the United States. While it may sound like an appealing proposition to get a criminal case dismissed via PC1000, it gives Homeland Security the right to terminate your stay in the country because of the diversion.
Non-US citizens arrested on drugs charges should consult My Rights Law to understand their situation. It may be that you don’t need to risk a diversion program or face conviction for crimes you have been arrested for. Alternatively, if it is in your best interests to choose this option, then we will do our best to establish your eligibility for it.

How to Avoid Getting Arrested at Coachella?

My Rights Law recommends the following steps to stay out of trouble at Coachella or Stagecoach. Don’t give the cops a chance to detain or arrest you.

  1. Keep Your Cool – Don’t get into fights and avoid getting overexcited. You are under no compulsion to prove yourself to anyone. Once you lose your cool over an aggravation, things can quickly go downhill, and you may be arrested for violence. At the very least, you could get chucked out of the festival.
  2. Be Alert – Keep your eyes open to any illegal activities happening around you. Know where the cops are present. If someone tells you about a person being a potential undercover cop, be extra vigilant. Steer clear of illicit activities happening in a group. Do not acknowledge that you’re carrying something illegal to a person you don’t know.
  3. Drink Water – Stay hydrated to prevent intoxication and the unruly conduct that may follow. Drinking water at Coachella and staying covered under the sun to keep cool can be the difference between being arrested or not.

Also, keep the following points in mind to avoid any potential run-ins with the law enforcement officers –

  • Your medical marijuana card is not a license for you to smoke weed at Coachella or Stagecoach. In fact, Coachella spells this out unambiguously on its website. You cannot smoke weed at the festival. A medical marijuana card is a recommendation and not a prescription. Federal law considers marijuana consumption illegal.
  • There will be a lot of undercover policepersons at Coachella, and you don’t have to be guilty to be targeted.
  • Know what to say to the cops. Ask them if you’re being detained and if yes, then for what. This clarity will stand you in good stead if the matter escalates. If your situation is such that you’re better off remaining silent, tell that to the cops, and then get in touch with a good lawyer.

What are the Implications of a Coachella Arrest for Professionals?

Professionals such as doctors, lawyers, nurses, vets, engineers, and architects are at a graver risk because an arrest at the festival can harm their careers. Many professionals take loans to acquire degrees. Licensing authorities can treat an arrest or a PC1000 diversion as sufficient grounds for revoking a license. We know how to move ahead with such cases where a slip can lead to major professional setbacks.
