What To Do if Charged With a DUI?

Stay Calm and Composed

When arrested for DUI, it’s important to remain calm and not agitate the situation. Reacting emotionally may be interpreted as a sign of intoxication. Politely answer questions related to identification, but avoid admitting guilt or making self-incriminating statements.

Provide Necessary Identification

Always have your driver’s license and registration handy. Law enforcement officers will request these documents as part of the standard procedure. Being prepared ensures that the process goes smoothly.

Know Your Right to Remain Silent

You are not obligated to answer questions beyond basic identification. Anything you say could be used against you. Contact your DUI attorney as soon as possible to ensure your rights are protected.

Request Legal Counsel

Never hesitate to ask for a lawyer. At My Rights Law, we provide immediate legal guidance, ensuring that your rights are upheld and the process is handled correctly. Having an attorney can drastically improve your chances of reducing or even dismissing charges.

Remain calm, stay informed, and contact a skilled DUI attorney to guide you through this situation.

Why Do You Need Ontario DUI Lawyers?

Challenge the Stop or Arrest

Many DUI arrests happen without proper cause. Our DUI defense attorneys will review every detail of the arrest, ensuring that no rights were violated during the stop or arrest.

Question Field Sobriety Tests

Field sobriety tests are subjective and prone to error. Our lawyers carefully examine how these tests were administered and whether they were performed correctly, which can be critical in your defense.

Challenge Breathalyzer Results

Breathalyzer tests aren’t always accurate. Mechanical errors, calibration issues, or improper administration can affect results. We are prepared to challenge the validity of these tests if necessary.

Negotiate for Reduced Charges

We work tirelessly to secure reduced charges or negotiate plea bargains, potentially minimizing the consequences of a DUI charge. In some cases, we can help you avoid severe penalties entirely.

Build a Solid Defense Strategy

Our experienced DUI attorneys build tailored defense strategies, utilizing common defenses such as faulty equipment, unlawful traffic stops, or mistaken identity to improve your chances in court.

The role of a criminal defense attorney in your DUI case

Although you may feel like defending yourself is an option, a professional DUI lawyer brings invaluable experience to the table:

Arraignment

Your lawyer will guide you through the arraignment process, helping you form the right plea and protecting your interests.

Pre-Trial Hearings

During pre-trial hearings, your lawyer can challenge evidence, negotiate with prosecutors, and sometimes have charges reduced or dismissed.

Trial

If the case goes to trial, your DUI attorney will represent you in court, fighting for your rights and seeking the best possible outcome.

Appeal

If convicted, your attorney will discuss your options for appealing the decision and guide you through the entire appeal process.

The Ontario DUI lawyers at My Rights Law are committed to walking you through every phase of your case, ensuring that you fully understand your options and rights at all times.

What To Expect After An Ontario Drunk Driving Arrest

After a DUI arrest in Ontario, the police may impound your vehicle and take you to the station for processing, which includes photographing and fingerprinting. While you’ll likely be released afterward, the real test will come in court, where the judge will determine your fate. It’s crucial to remain calm, cooperate with authorities, and, most importantly, contact an experienced DUI lawyer as soon as possible. Having legal representation early in the process increases your chances of a favorable outcome, potentially reducing penalties or even having charges dismissed.

Our Ontario DUI Defense Approach

When defending against DUI charges in Ontario, My Rights Law takes a comprehensive approach, combining standard legal defenses with strategies tailored to your unique situation. Our skilled attorneys ensure every angle of your case is explored to secure the best possible outcome. Here’s how we handle your DUI case:

Thorough Case Analysis

Our team begins by carefully investigating the circumstances surrounding your DUI charge. This involves reviewing all police reports, evidence, breathalyzer results, and any witness statements to identify weaknesses in the case and create a strong defense.

Strategic Defense

Once we understand the facts, we craft a personalized defense strategy. This may involve challenging the legality of the traffic stop, questioning the validity of sobriety tests, and uncovering errors or inconsistencies in the prosecution’s case.

Transparent Communication

We believe in keeping you informed every step of the way. Our attorneys provide clear, honest updates so that you know exactly where you stand and how we are working to resolve your case in the best possible way.

Relentless Negotiation

If possible, we’ll negotiate with the prosecution to secure a favorable plea deal, aiming to reduce your penalties. My Rights Law’s experienced lawyers will fight for your rights at every stage of the process.

Trial-Ready Representation

If your case goes to trial, rest assured that My Rights Law’s attorneys are ready. With extensive courtroom experience, we have a proven track record of defending DUI charges in Ontario courts.

Legal Penalties for Ontario DUI

While a DUI offense may seem minor, it can lead to severe consequences in Ontario. The penalties for a first-time DUI offense can include:

Fines: The maximum fine for a first DUI offense is up to $1000, including a base fee and additional penalties. Alternatively, the fine can be converted to 13 days of jail time or 13 days of community service with Cal-Trans.

License Suspension: Your driver’s license may be suspended for six months. In many cases, however, an Ignition Interlock Device (IID) may allow you to continue driving during this period.

DUI Education: The court may mandate attending DUI school for a period ranging from 6 weeks to 3 months.

Probation: Probation is often imposed for a period of three years. It may be formal, with regular check-ins with a probation officer, or informal with specific conditions that you must follow.

In addition to these penalties, a DUI conviction often results in increased car insurance premiums. Penalties can escalate for repeat offenses:

Second Offense DUI:

  • Probation: 3 to 5 years of probation.
  • Fine: Up to $2000.
  • License Suspension: Up to 1 year, with the possibility of installing an IID.
  • DUI Education: 18 to 30 months of alcohol education.
  • IID Requirement: IID installation for 1 year.

Third Offense DUI:

  • Probation: 3 to 5 years of probation with strict terms.
  • Fine: Up to $2500.
  • License Suspension or Revocation: License suspension or revocation for up to 3 years, with restricted driving privileges after 180 days, subject to IID installation and chemical testing.
  • Jail Time: Potential for 120 days to 1 year in jail.
  • IID Requirement: IID installation for 2 years.
  • Additional Penalties: Community service, mandatory AA meetings, or further alcohol treatment programs may be required.
